By downloading, installing, or using Echo ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. These Terms apply to all users of the App.
Echo is a private journaling application that allows you to record personal thoughts, feelings, and voice notes ("Memories"), seal them for a chosen period, and receive them back at a future date. All content is stored exclusively on your device and encrypted using AES-256 encryption. Echo does not operate any servers that store your Memories.
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.
Echo offers a free 14-day trial followed by an optional paid subscription ("Echo Premium"). Subscriptions are billed through the Apple App Store on a recurring basis. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your device's App Store settings. No refunds are provided for partial subscription periods, except where required by applicable law.
Echo offers a 14-day free trial beginning on your first successful Memory save. The trial grants access to all features of Echo Premium. At the end of the trial period, continued use of premium features requires a paid subscription. The free trial is available once per user and cannot be reset by reinstalling the App.
You are solely responsible for all content you create, store, or transmit using the App ("Your Content"). You retain full ownership of Your Content. Because all data is encrypted on-device and never transmitted to our servers, we have no ability to access, moderate, or recover Your Content. You agree not to use the App to store content that is illegal under applicable law.
Echo uses a Recovery Key to encrypt and decrypt your Memories. You are solely responsible for safeguarding your Recovery Key (Recovery Phrase or QR Code). If you lose your Recovery Key and uninstall the App, your Memories cannot be recovered by Echo or anyone else. We strongly recommend viewing and securely storing your Recovery Key as soon as possible. Echo accepts no liability for data loss resulting from a lost or forgotten Recovery Key.
Echo is designed with privacy as its foundation. We do not collect, transmit, or store your personal data or Memories on any server. Our full Privacy Policy is available within the App and describes our data practices in detail. By using the App, you agree to the collection and use of information in accordance with our Privacy Policy.
The App, including its design, code, graphics, and branding, is the intellectual property of the Echo development team and is protected by copyright and other applicable laws. These Terms do not grant you any rights to use our trademarks, logos, or brand features. You may not copy, modify, distribute, sell, or lease any part of the App or its content.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
To the maximum extent permitted by applicable law, Echo and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of or inability to use the App. Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid for the App in the 12 months preceding the claim.
You may stop using the App at any time by deleting it from your device. We reserve the right to terminate or suspend access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
We may update these Terms from time to time. We will notify you of material changes by updating the date at the bottom of this page or through an in-app notice. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Brampton, Ontario, Canada.
